These Terms of Service ("Terms") govern your access to and use of Auctado at https://auctado.com ("Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Auctado is a discovery hub for auction listings syndicated from third-party auction companies. We help you search and compare lots. We do not conduct auctions, accept bids, process payments, or guarantee listing accuracy. All bidding and purchases occur on the source auction website under that site's terms.

Accounts

Some features (such as saved searches) require an account. You may register with email or supported social login providers. You are responsible for activity under your account and for keeping credentials secure. You must provide accurate information and be old enough to form a binding contract where you live.

Acceptable use

You agree not to:

• Use the Service unlawfully or to harm others;
• Scrape, overload, or interfere with the Service or its systems;
• Attempt unauthorized access to accounts or data; or
• Misrepresent your affiliation or the origin of content.

We may suspend or terminate access for conduct we reasonably believe violates these Terms or poses risk to the Service.

Third-party sites and content

Listings link to external sites we do not control. We are not responsible for third-party content, pricing, availability, or transactions. Your use of external sites is at your own risk and subject to their policies.

Intellectual property

The Service, branding, and software are owned by us or our licensors. Listing content remains the property of its respective publishers. You receive a limited, revocable license to use the Service for personal, non-commercial discovery purposes unless we agree otherwise in writing.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUCTADO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (TYPICALLY $0 FOR FREE USE).

Indemnity

You will defend and indemnify us against claims arising from your misuse of the Service or violation of these Terms, to the extent permitted by law.

Changes

We may modify the Service or these Terms at any time. Material changes will be posted on this page. Continued use after changes constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of Iowa, USA, without regard to conflict-of-law rules, except where mandatory local law applies. Disputes will be resolved in courts located in Iowa, unless applicable law requires otherwise.
